PLEASE READ THESE RULES CAREFULLY. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW AND OUTSIDE THE U.S. AND CANADA.
PARTICIPATION IN THE CONTEST REQUIRES ACCEPTANCE OF THESE OFFICIAL RULES, WHICH INCLUDE A CLASS ACTION WAIVER AND ARBITRATION CLAUSE. IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, YOU MUST NOT PARTICIPATE IN THE CONTEST.
The Torrid Casting Call 2025 (“Contest”) is sponsored by Torrid LLC (“Sponsor”). The Contest is not sponsored, administered, or otherwise endorsed by any social media platform, including without limitation X, Meta, TikTok, or Instagram.
1. Contest Description.
Torrid is clothing destination for women wearing sizes 10 to 30. For 24 years, we’ve been redefining beauty standards, revolutionizing the fashion industry, and making sure curvy women are not only represented, but celebrated. As we continue to grow with exciting new brands like Festi, Nightfall, Retro Chic, Belle Isle and LoveSick, Casting Call plays an even bigger role: finding fresh, diverse ambassadors and models who can bring these stories to life in authentic, powerful ways. Our Casting Event will be held Los Angeles, CA with applications also available online and in Torrid stores, to help us identify the finalists and ultimately find the Torrid Casting Call 2025 winners in each of five age groups: (18-19), (20-29), (30-39), (40-49), and (50+) (each, a “Group”).
2. Eligibility.
The Contest is open to legal residents currently residing in the 50 United States (and D.C.), Puerto Rico, or Canada (excluding Quebec) who are 18 years old or the age of majority in their jurisdiction of residence, whichever is older, at the time of entry (“Applicant”).
Eligible Applicants must:
- Be someone who is inspired by the Torrid brand.
- Fit within Torrid brand sizes 10-30.
- As may be required, be legally eligible to work in the United States. Prior to receipt of any prize or to becoming a Finalist (as defined below), Applicant may be required to provide proof of such eligibility to Sponsor.
- Be willing and able to travel to Los Angeles, California to participate in a “Model Boot Camp,” (as defined below) interviews, recording and photography sessions and other activities as scheduled by Sponsor. Such travel may require Applicant to be away from their place of residence for up to one (1) week. Possession of valid government-issued driver license, Real ID, or Passport may be required (as applicable based on jurisdiction of residence) for air travel. Any such travel will be at Sponsor’s cost, as provided below..
- Be willing to create (or use existing) accounts on social media platforms, as determined by Sponsor in its sole discretion. Any such account will be subject to legally required guidelines and will be free to create and maintain.
- Be willing to submit to a background check, including employment, motor vehicle, criminal, credit, consumer reports, and reviews of publicly available information such as social media account posts.
Eligible Applicants must not:
- Be a current candidate for public office or anticipate running for or holding public office within two (2) years of the end of the Entry Period (as defined below).
- Be a professional model or already signed to/with a talent/modeling agency for exclusive representation.
- Be a former Grand Prize Winner of any of Sponsor’s prior Model Search or Casting Call contests.
Employees, officers, and directors of Sponsor or any of its respective parents, affiliates, subsidiaries, representatives, agents, consultants, contractors, legal counsel, advertising, public relations, promotional, prize fulfillment, and marketing agencies (collectively, “Contest Entities”) and members of their immediate families (parents, legal guardians, children, grandparents, grandchildren, spouses or siblings and their respective spouses, regardless of where they live) and those living in their same households, whether or not legally related, are not eligible to enter or win the Contest.
Participation in the Contest constitutes Applicant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Contest. Becoming a Finalist and winning a prize is contingent upon fulfilling all requirements, as set forth herein. Sponsor reserves the right to verify the eligibility of Applicants, Semi-Finalists, Finalists, and Contest Winners, at each stage.
3. Important Dates / Timeline.
- Entry Period. Contest begins at 12:00:01 AM Pacific Time (“PT”) on September 9, 2025 and ends at 11:59:59 PM PT on October 8, 2025 (“Entry Period”). Sponsor’s computer is the official time keeping device for the Contest.
- Semi-Finalist Notification. The top 30 semi-finalists (six from each Group) will be notified by e-mail on or about October 10, 2025. Each semi-finalist must indicate acceptance of semi-finalist status within 24 hours and comply with all other requirements of Sponsor as may be indicated in notification in order to advance to the next stage of the Contest.
- Public Voting Period. Public voting to determine the top 15 finalists (three from each Group) will occur October 21, 2025, 12:00:01 AM PT through October 28, 2025, 11:59:59 PM PT.
- Finalist Notification. The top 15 finalists will be notified by e-mail on or about October 29, 2025. Each finalist must indicate acceptance of finalist status within 24 hours and comply with all other requirements of Sponsor as may be indicated in notification in order to advance to the next stage of the Contest.
- Model Boot Camp. The top 15 finalists will travel to Los Angeles and participate in various activities from November 6-8, 2025.
- Winner Notification. The final five winners (one from each Group) will be notified on or about November 11, 2025.
4. How to Enter.
Application. During the Entry Period eligible individuals should visit the Casting Call Website, to complete and submit an online application (“Application”). The Application must include all requested information (e.g., name, address, phone number, email) as well as all requested photos and videos. Specific requirements for photos and videos will be provided on the Casting Website. Upon completion and submission of the Application, Applicant will be automatically entered into the Contest (“Entry”). LIMIT ONE ENTRY PER PERSON. ADDITIONAL ENTRIES SUBMITTED BY THE SAME PERSON WILL BE DISQUALIFIED.
Entry must be submitted by Applicant. Automated or bulk Entries or Entries submitted by third parties will be disqualified. Any attempt by any Applicant to obtain more than the stated number of Entries by using multiple and/or different identities, forms, registrations, email addresses, login, or any other methods will void that Entry, and Applicant may be disqualified at Sponsor’s discretion. Sponsor shall not be responsible for lost, misdirected, misplaced, stolen, tampered with, deleted, or invalid Entries or any expenses incurred in the creation and submission of any Entry. Message, data rates, and wireless access charges may apply to use of a mobile device in connection with Entry.
In-Person Casting Events. On October 4, 2025, Sponsor will host one in-person event at the Torrid Headquarters located at 18501 E. San Jose Avenue, City of Industry, California 91748 (the “Casting Event”). At the Casting Event, photographers will be on hand to take photographs of Applicants, which may be used for submission with the Application. The Casting Event is not in lieu of submission of an Application. It is simply an optional way for an Applicant to obtain photos necessary for submission with the Application. Please note that Applicants may take their own photos for submission, and photos taken at the Casting Event will not be judged differently than photos taken by the Applicant nor will they impact or improve an Applicant’s chances of winning. Attendance at the Casting Event is optional and will not in any way influence or affect the review of an Application.
5. Material Submitted with Application.
By submitting photographs, videos, or other materials in connection with the Application (collectively, “Application Content”), Applicant hereby grants to Sponsor and Contest Entities an irrevocable, perpetual, royalty-free, non-exclusive, worldwide license to use, reproduce, create derivative works based on, distribute, display, and publicly perform such Application Content (i) in and in connection with the Contest and/or Program, (ii) to advertise and promote the Contest, Program, and Sponsor, and (iii) for such other uses as Sponsor may determine in Sponsor’s sole discretion.
By submitting an Application and related Application Content, Applicant represents and warrants that: (i) they have the right to grant the rights granted in these Official Rules with respect to such Application Content; (ii) the consent of no other person, firm, corporation or other entity is required to enable Sponsor to exercise the rights granted in these Official Rules with respect to the Application Content; (iii) Sponsor’s use of the Application Content will not violate the rights of any third party; and (iv) Sponsor shall have the right to use the Application Content free and clear of any claims for royalties, licenses, or other compensation.
Applicant waives any moral rights they may have to the Application Content and agrees that if Sponsor elects to use Application Content for any purpose, all rights under copyright or other intellectual property rights which may result from that use shall be the sole property of Sponsor. Applicant further agrees that, if necessary, Applicant will execute any documents requested by Sponsor regarding these rights and assignment. Applicant hereby agrees to indemnify Sponsor and Contest Entities from and against any and all damages, costs, judgments, and expenses (including reasonable attorney fees) which may be incurred as a result of use of the Application Content. Application Content will not be returned to Applicant.
6. Selection and Notification of Semi-Finalists, Finalists, and Winners.
Selection and Notification of Semi-Finalists: Following the close of the Entry Period, a panel of judges consisting of representatives of Sponsor (“Judges”) will score each eligible Applicant based on the following criteria: physical presence, photogenic quality, charisma, versatility, and overall personality (“Judging Criteria”).
The top six (6) Applicants from each Group with the highest scores based on the Judging Criteria, as determined by Sponsor, will become “Semi-Finalists.” On or about October 10, 2025, Sponsor will notify Semi-Finalists of their status via email sent to the email address provided to Sponsor on the Application.
Selection and Notification of Finalists: On or about October 21, 2025, the submitted photos and videos of the thirty (30) Semi-Finalists will be posted to https://www.torrid.com/castingcall2025 (“Voting Website”). Between 12:00:01 AM PT on October 21, 2025 and 11:59:59 PM PT on October 28, 2025 (“Public Voting Period”), the general public will have an opportunity to vote for their favorite Semi-Finalist by visiting the Voting Website and following the on-screen instructions.
Following the close of the Public Voting Period, the three (3) Semi-Finalists from each Group with the highest public vote count will be named “Finalists.” On or about October 29, 2025, Sponsor will notify Finalists of their status via email sent to the email address provided to Sponsor on the Application.
From November 6-8, 2025, Finalists will attend a “Model Boot Camp,” which will include activities such as participation in a modeling mentorship, a photoshoot session, a digital content creation workshop, and/or other activities as determined in Sponsor’s sole discretion. A panel of judges consisting of representatives of Sponsor will judge the Finalists based on their social media skills, online presence, professionalism, creativity, and innovation throughout the Model Boot Camp.
Selection and Notification of Winner. Selection and Notification of Contest Winners. On or about November 11, 2025, the Finalist in each Group with the highest score from Model Boot Camp will be selected as a “Contest Winner” and will be notified of their status via email sent to the email address provided to Sponsor on the Application.
Semi-Finalists, Finalists, and/or Contest Winners will be selected on the basis of skill in meeting the criteria and the number of eligible entries received during the Contest Period.
Sponsor’s and Judges’ decisions on all matters related to the selection of Semi-Finalists, Finalists, and Winner shall be final and binding.
Tie-breakers: If a tie exists in any round of judging, the Applicant with the highest total score on each of the Judging Criteria will be selected to advance. In the unlikely event of a further tie, the tied Applicants will be re-judged until the tie is broken.
It is an Applicant’s responsibility to monitor their email address. Sponsor is not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify Semi-Finalists, Finalists, or Contest Winners. If Sponsor is unable to contact an Applicant or Applicant has not responded within 24 hours from when the notification was sent, is not in compliance with these Official Rules, or declines to participate (or accept a prize) for any reason prior to award, their status in the Contest (or as a recipient of any prize) will be forfeited and, in Sponsor’s sole discretion, an alternate Applicant may be selected.
ALL POTENTIAL SEMI-FINALISTS, FINALISTS, AND CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. AN APPLICANT MAY NOT ADVANCE TO THE NEXT ROUND OF THE CONTEST UNLESS AND UNTIL THEIR ELIGIBILITY, INCLUDING A BACKGROUND CHECK, HAS BEEN VERIFIED, AND THEY HAVE BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
7. Prizes.
Each of the fifteen (15) Finalists will receive a prize (each, a “First Place Prize”) consisting of: (i) round trip, economy class airfare from a major airport nearest the Finalist’s residence to Los Angeles, California; (ii) standard hotel accommodations at a 4-star hotel for two (2) nights; and (iii) $50 USD per diem (for two (2) days). Total Approximate Retail Value (“ARV”): $1,500 USD (based on sample New York City departure).
In addition to the above-mentioned First Place Prize, each of the five (5) Contest Winners will receive the following prize (each, a "Grand Prize”):
- Opportunity to be featured in a 2025 or 2026 Torrid campaign photoshoot;
- A Torrid wardrobe for a year valued at $15,000 USD or $15,000 CAD depending on the location of residence of the Contest Winner, which shall be delivered to Contest Winner as a monthly Torrid e-Gift card or physical gift card in the amount of $1,250 USD or $1,250 CAD. e-Gift card and Gift cards are subject to Torrid’s terms and conditions, available here;
- A cash prize in the amount of $5,000 USD or $5,000 CAD depending on the location of residence of the Contest Winner; and
- Opportunity to receive a modeling contract from a global talent management agency.
ARV of Grand Prize: $20,000 USD or CAD depending on jurisdiction of residence.
ARV of all Prizes: $122,500 USD or CAD depending on jurisdiction of residence.
Any photos taken or materials created during the Contest may, at Torrid’s sole discretion, be published and/or used in or in connection with any Torrid advertising or Torrid advertising campaign. Nothing in these Official Rules guarantees or suggests that Contest Winners will have their image used by Torrid in or in connection with any Torrid advertising or Torrid advertising campaign. Any use of Contest Winners’ image in connection with Torrid advertising will be at Torrid’s sole discretion.
8. Prize Restrictions.
All Semi-Finalists, Finalists, and Contest Winners will be required to sign and return a Declaration of Eligibility and Liability/Publicity Release, consent to a background check, and may be required to sign other documents that Sponsor deems necessary to confirm eligibility, complete the background check, and obtain a liability/publicity release. Failure to return any required document by the date requested may deem the Applicant ineligible and their related prize (or status in the Contest) forfeited.
Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion. Sponsor will not replace any lost or stolen prizes or components thereof.
In the event Finalist engages in behavior during prize travel or at prize-related event (including Model Boot Camp) that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the travel early, and send Finalist home with no further obligations or compensation whatsoever to Finalist (which may, in Sponsor’s sole discretion, result in such Finalist’s disqualification from the Contest and forfeiture of any (and/or all) prize(s)). In the event Finalist engages in behavior during prize travel or at prize-related event (including Model Boot Camp) that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects Finalist to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Finalist as a result of such conduct. SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF FINALIST’S ACCEPTANCE OR USE OF THE PRIZE (INCLUDING PARTICIPATION IN MODEL BOOT CAMP).
If any Finalist resides within a 200-mile radius of Los Angeles, California, Sponsor reserves the right to substitute round-trip ground transportation to/from Finalist’s residence in lieu of air transportation. Finalist shall be responsible for obtaining all necessary travel documents, including visas (if applicable). Travel arrangements will be made through Sponsor and on an airline carrier of Sponsor’s choice. Finalist must be available to travel on dates specified by Sponsor or risk forfeiting prize. Certain travel restrictions may apply. Finalist shall be responsible for obtaining travel insurance (and all other forms of insurance) at their option, and hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Finalist’s transportation, and such contracts shall be solely between the Finalist and such transportation companies. Lost, stolen, or damaged airline tickets will not be replaced or exchanged. No stopovers are permitted on tickets issued as part of the Prize. If a stopover occurs, the prize travel will terminate, and Finalist will be responsible for the full fare, which will be charged from the stopover point for the remaining trip segment(s), including the return. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carrier(s) or other transportation companies or any other persons providing any of these services to passengers including any results thereof such as changes in services or accommodations necessitated by same. Airline tickets issued in connection with the prize may not be eligible for frequent flyer miles or upgrades. Finalists must comply with all hotel check-in requirements, including, but not limited to, the presentation of a payment card.
Any difference between ARV and actual retail value of any prize will not be awarded. The actual value of any prize awarded may be taxable as income, and any applicable federal, provincial, territorial, state, or local tax related to the acceptance and/or use of any prize shall be the sole responsibility of the prize winner. Winners may be required to provide Sponsor with a valid social security number or tax identification number, as required by applicable law, for tax reporting purposes before any prize will be awarded. For prize winners residing in the United States, as the value of the prize equals or exceeds $600, Sponsor must report the value to the Internal Revenue Service (“IRS”) and will issue an IRS Form 1099 to the winner(s), where applicable, for the value of the prize received.
All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Sponsor will provide Applicants with reasonable notice of any change to the prize details. Unclaimed prizes will be forfeited.
9. General Conditions.
This Contest is governed by the laws of the United States. Subject to reasonable prior notice to Applicants, Sponsor reserves the right to cancel, suspend, and/or modify the Contest, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity, operation, or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor is not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible Entries; lost, interrupted, or unavailable network, server, or other connections, garbled transmissions or miscommunications, telephone transmission problems; computer or software malfunctions or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of Entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. WARNING.
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be attempting to tamper with or undermine the entry process, any website or account associated with the Contest, and/or the legitimate operation of the Contest; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Contest is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect Entries and (a) subject to reasonable prior notice to Applicants, modify the Contest or suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) award the Prize(s) at random from among the eligible, non-suspect Entries received up to the time of the impairment.
11. LIMITATIONS OF LIABILITY; RELEASES; INTELLECTUAL PROPERTY.
By participating in this Contest, Applicant agrees that Sponsor and its respective affiliates, subsidiaries, parent corporations, and their officers, directors, employees, representatives and agents (“Released Parties”) are, to the extent permitted by applicable law, not responsible for: incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of Applications; printing or other errors; technical failures of any kind; any Applications which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, or any combination thereof; and any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Applicant’s participation in the Contest or receipt or use or misuse of any prize.
EXCEPT WHERE PROHIBITED BY LAW, BY PARTICIPATING IN THIS CONTEST, APPLICANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY APPLICANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, ENTRY, OR PARTICIPATION IN THIS CONTEST OR IN ANY CONTEST-RELATED TRAVEL OR ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, OR OTHER INTELLECTUAL PROPERTY RIGHTS, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, TERRORISM, OR ACTUAL OR THREATENED PUBLIC HEALTH CRISES (INCLUDING, WITHOUT LIMITATION, PANDEMICS AND EPIDEMICS AND ANY GOVERNMENT SHUTDOWNS OR RESTRICTIONS RELATED THERETO).
BY PARTICIPATING IN THIS CONTEST, APPLICANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE.
EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE CONTEST CONSTITUTES SEMI-FINALISTS’, FINALISTS’, AND CONTEST WINNERS’ GRANT TO SPONSORS (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSORS), AND THE RELEASED PARTIES, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, AT ANY TIME OR TIMES, EACH SEMI-FINALISTS’, FINALISTS’, AND CONTEST WINNERS’ NAME, LIKENESS, SOCIAL MEDIA HANDLE, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. NOTHING CONTAINED HEREIN SHALL BE DEEMED TO OBLIGATE SPONSOR TO MAKE USE OF ANY OF THE RIGHTS GRANTED HEREIN, AND SEMI-FINALISTS’, FINALISTS’, AND CONTEST WINNERS’ WAIVE ANY RIGHT TO INSPECT OR APPROVE ANY SUCH USE OF ANY AND EVERY NATURE AND KIND AND CONSENT TO ANY SUCH APPROPRIATE AND LEGALLY PERMISSIBLE USE THEREOF.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS CONTEST, INCLUDING ALL PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
12. Governing Law / Disputes.
Except where prohibited by applicable law, each Applicant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and shall be governed by and construed in accordance with the laws of the State of California, and the forum and venue for any dispute arising out of or related to this Contest shall be the federal and state courts within Los Angeles, California and agrees not to oppose any action brought in Los Angeles, California on the basis that the courts there are not an appropriate or convenient forum for same; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (not to exceed $10 USD), but in no event attorneys’ fees; (iii) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits, may be awarded (collectively, “Special Damages”), and Applicant hereby waives all rights to claim Special Damages, all rights to have such damages multiplied or increased, and all rights to seek injunctive or other equitable relief. California law, without reference to California’s choice of law rules, governs the Contest and all aspects related hereto.
If the controversy or claim is not otherwise resolved through direct discussions or mediation, it shall then be resolved by final and binding arbitration administered by the American Arbitration Association, in accordance with its Arbitration Rules and Procedures or subsequent versions thereof (“AAA Rules”). The AAA Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in the State of California.
Applicants agree that the statute of limitations for asserting any claims shall be a period of one (1) year from the end date of the Contest Entry Period.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any applicant and/or Sponsor shall be governed by and construed in accordance with the laws of the State of California without reference to conflict of laws principles. If any provision or provisions of these Official Rules shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
13. Privacy Policy.
Information submitted by or collected from Applicants in connection with the Contest shall be subject to Sponsor’s privacy policy, available at https://www.torrid.com/torrid/customer-service/about-torrid/td-customerservice-abouttorrid-privacyresponsibility.html. By entering this Contest, Applicant expressly consents to Sponsor and its agents, and/or representatives, storing, sharing, and using the personal information submitted only for the purposes described in these Official Rules, including for the purpose of administering the Contest. It is necessary for and in the legitimate interest of Sponsor to use Applicants’ personal data to perform obligations related to the administration of this Contest.
Applicants acknowledge and agree that their personal information may be disclosed publicly in connection with the Contest as an Applicant, a Semi-Finalist, a Finalist, and a Contest Winner. By entering the Contest and/or accepting a First Place Prize or Grand Prize, Applicant agrees to allow Sponsor and/or Sponsor’s designee(s) the perpetual right to use their name, voice, image, biographical information, photos and/or likeness, and statements for Contest, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on the world wide web and Internet, without notice, review or approval and without additional compensation, except where prohibited by law.
If an Applicant does not provide Sponsor with the requested personal information required to enter the Contest, Applicant will not be able to participate in the Contest.
14. Additional Prohibitions.
No firearms or weapons of any sort are to be possessed or brought to any location by any Applicant at any time during the Contest, live Casting Event, Model Boot Camp, or any photo shoot or other activity related thereto.
Except during the Public Voting Period to solicit votes from the public, Applicant shall not disclose to any person, firm or entity, any information regarding the Contest or Applicant’s involvement therein, unless otherwise pre-approved by Sponsor in writing. Without limiting the generality of the foregoing, Applicant shall not disclose any information regarding any Semi-Finalists, Finalist, or Contest Winner.
Physical violence or verbal abuse will not be tolerated. Applicants shall treat each other and all Torrid employees with respect at all times during the Contest and at any Contest-related activity.
Applicants shall not negligently or willfully damage any Torrid location, hotel accommodation, photo shoot location, or any other personal or real property of Sponsor or any of the other Applicants.
Drugs or other illegal substances or any use thereof (other than drugs that have been prescribed for the Applicant or over the counter medications) will not be tolerated. This includes, without limitation, prescription drugs for which Applicant does not have a valid, current written prescription from a medical doctor, and the consumption of alcohol if Applicant is not of legal drinking age. Penalty for non-compliance is immediate dismissal and forfeiture of prize(s) (if applicable).
SPONSOR’S FAILURE TO ENFORCE THE RULES ON ONE OCCASION, OR IN CONNECTION WITH A PARTICULAR APPLICANT, SHALL NOT PRECLUDE SPONSOR LATER FROM ENFORCING THE RULES ON ANOTHER OCCASION OR WITH RESPECT TO THE SAME OR A DIFFERENT APPLICANT.
APPLICANTS MUST OBEY ALL FEDERAL, PROVINCIAL, TERRITORIAL, STATE AND LOCAL LAWS AND REGULATIONS IN THEIR JURISDICTION OF RESIDENCE, AND EACH APPLICANT ACCEPTS FULL RESPONSIBILITY FOR THEIR BEHAVIOR AND ACTIONS.
SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY APPLICANT AT ANY TIME, IN SPONSOR’S SOLE AND ABSOLUTE DISCRETION, INCLUDING, WITHOUT LIMITATION, IF THEY HAVE VIOLATED THESE RULES, MISREPRESENTED THEMSELF IN ANY WAY, WHETHER BY INCOMPLETELY, INACCURATELY OR MISLEADINGLY REPLYING OR BY FAILING TO REPLY TO ANY QUESTION, OR OTHERWISE, AND SUCH DISQUALIFIED APPLICANT WILL FORFEIT THE RIGHT TO RECEIVE ANY PRIZE(S). ENFORCEMENT OF THESE RULES SHALL BE AT SPONSOR’S ABSOLUTE DISCRETION. ANY APPLICANT DISQUALIFIED OR OTHERWISE REMOVED FROM THE CONTEST MAY BE REPLACED BY AN ALTERNATE APPLICANT AT ANY TIME, AT THE ABSOLUTE DISCRETION OF SPONSOR.
APPLICANT COLLUSION IS PROHIBITED AND MAY BE ILLEGAL, AND ANY UNAUTHORIZED COMMUNICATION AMONG APPLICANTS OR ANY OTHER THIRD PARTY IS STRICTLY PROHIBITED. APPLICANT MUST NOTIFY SPONSOR IMMEDIATELY IF ANY APPLICANT ATTEMPTS TO INITIATE ANY SUCH COMMUNICATION WITH THEM BEFORE, DURING, OR AFTER PUBLIC VOTING OR OTHERWISE DURING THE CONTEST.
APPLICANTS ARE NOT PERMITTED TO SHARE ANY PRIZE MONEY OR ANY PORTION OF A PRIZE WITH ANY OTHER APPLICANT. THEY MAY NOT MAKE PLANS OR AGREEMENTS, WHETHER IN WRITING OR ORALLY, TO DO SO. APPLICANTS WILL BE MONITORED THROUGHOUT THE CONTEST. ANY APPLICANT FOUND CONSPIRING OR COLLUDING WITH ANOTHER APPLICANT WILL BE DISQUALIFIED FROM THE CONTEST AND MAY BE LEGALLY PROSECUTED.

16. Miscellaneous
The invalidity or unenforceability of any provision of these Official Rules or any prize acceptance documents shall not affect the validity or enforceability of any other provision. Should any provision of the Official Rules be determined invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. To the fullest extent permitted by applicable law, Applicants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event of a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials, privacy policy, or terms of use on a Contest-related website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.
