This Privacy Policy helps you understand how Torrid, our affiliates, and subsidiaries collect, use, and share your Personal Information when you engage with us online or offline, such as when you visit our website (“Site”), use the Torrid mobile application (“App”), or go to one of our retail stores (collectively referred to as our "Services").

TORRID and all associated Services and systems are DIRECTED AT RESIDENTS OF THE UNITED STATES AND housed on servers in the United States. If you are located outside of the United States, information we collect (including cookies) is processed and stored in the United States, which may not offer the same level of privacy protection as the country where you reside or are a citizen By using the Services and providing information to us, you consent to the transfer to and processing of the information in the United States.


1. What Information We Collect
We collect information that identifies, describes, or is reasonably capable of being associated with you (“Personal Information”). The following discusses the categories of Personal Information we collect, the sources we collect information from, and the business or commercial purposes we use your Personal Information.

1.1 When You Visit Our Site or Use Our App
We may collect the following Personal Information directly from your activity on our Site or App:
  • Geolocation information, such as your IP address, which links to the region you live in, when you visit our Site or App.
  • Commercial information, such as information about the Services you use and products you order.
  • Personal identifiers, such as your email address if you sign up to receive emails from us.
  • Inferences and preferences, such as the products you prefer, your communications preferences, and other inferences drawn.
  • Internet and network information, as described in more detail in our Cookies and Advertising Policy, if you visit our Site or use the App, we automatically collect information about your browsing and search history, interaction with the features of our Site or App, and responses to advertisements.
We use this information to understand how we can exceed your expectations, improve and customize our products and Services, and evaluate the effectiveness of our marketing campaigns.

1.2 When You Make a Purchase
When you make a purchase with us in our stores or checkout on our Site or App, we collect the following information from you:
  • Personal identifiers, such as your name, phone number, email address, and shipping address.
  • Financial information, such as your payment card number, billing address, and related financial information.
  • Commercial information, such as your purchasing history at Torrid.
The main reason we use your Personal Information is to fulfill your orders and process your payment. We also use your information to provide you a receipt or order confirmation, deliver order updates, and otherwise communicate with you about our products and Services.

We use third-party payment processors to assist with securely processing your payment information. If you pay with a credit card or other form of electronic payment, the payment information that you provide through the Services is encrypted and transmitted directly to the payment processor. We do not store your payment information and do not control and are not responsible for the payment processor or its collection or use of your information. You may find out more about how payment processors store and use your payment information by accessing the privacy policy for the payment processor’s services.

If you choose to use PayPal to make purchases through the Site, you will be directed to the PayPal website and provide your payment information directly to PayPal. PayPal’s privacy policy applies to the information you provide on the PayPal website.

1.3 If You Make an Account or Sign Up For Rewards
If you register with Torrid Rewards or create an account online or through our App, we collect the following information directly from you:
  • Personal identifiers, such as your name, birthday, phone number, email address, and shipping address.
  • Account information, such as your account age, account number, username, password, and similar information.
We use this information to maintain your account, perform transactions you request, and otherwise run day-to-day operations. We use this information to communicate with you about your account or rewards and to assist if you have a question about your account. We may also use the information you provide us to notify you if we materially update our Privacy Policy or Terms of Use.

1.4 If You Get The Torrid Credit Card
Torrid has partnered with Bread Financial, operating as Comenity Bank (“Comenity”), to offer customers the option to finance their purchases with a Torrid Credit Card. Comenity may collect your Personal Information to make pre-approval offers for the Torrid Credit Card.

If you apply for a Torrid Credit Card, Comenity will collect the Personal Information needed to process your application, finance purchases, and manage billing. Torrid does not control Comenity and is not responsible for how Comenity may treat your Personal Information. Review Comenity’s privacy policy and other terms to understand how they collect, process, store, or disclose your information.

1.5 When You Leave A Review
If you post information to our Site or App, such as a photo or a review, we may collect the information you provide such as:
  • Personal identifiers, including your name and location.
  • Audio, visual, or similar information, including any photos you post.
  • Inferences and preferences, including your feedback on our clothing or similar information.
We use this information to demonstrate the style and fit of our clothing to other customers and to improve our products and Services.

1.6 Linked Social Media Accounts
If you choose to link or sign in to your social media accounts with us, we collect the following types of Personal Information from your social networking sites, depending on the terms of the social media site. If you use your social media account, we are not required to request further permission to collect information accessible through that account.
  • Personal identifiers, such as your name, birthday, email address, or location.
  • Audio, visual, or similar information, such as your profile picture.
  • Characteristics of a protected class, such as your gender or relationship status if you have this information on your public profile.
  • Social media information, such as your profile URL, user ID, list of friends, information related to friends and followers, likes, interests, posted messages and content.
  • Education information, such as your education history to the extent made available on your profile.
  • Employment information, such as your work history to the extent made available on your profile.
We use this information to connect and communicate with you. We may also use your information to conduct market research or tell you about products, services, or special offers on our own products or third-party products you might find interesting.

Your use of social media is subject to each social media site’s privacy policy, which may be different from ours. Please read those policies carefully to understand their information practices and your options. We have no control over the information collected by social media networks and we are not responsible for the practices of those sites.

1.7 If You Enter Our Sweepstakes or Promotions
If you participate in our contests, promotions, sweepstakes, or similar events, we may collect personal identifiers from you, such as your name, age, number, email address, or mailing address. We use this information to run the sweepstakes or promotion. We may also use this information to contact you about other news, promotions, or opportunities.

1.8 If You Contact Us
If you contact us by filling out our online webform, signing up to receive our emails, or calling our customer service line, we may collect the following Personal Information:
  • Personal identifiers, such as your name, account number, email address, or phone number.
  • Commercial information, such as your order information and purchasing history at Torrid.
  • Inferences and preferences, such as your feedback or other information you may provide.
We use this information to provide customer service, respond to your requests for help, comments, or concerns, and to improve our products and Services. We may also use this information to communicate with you about our products and Services, or special offers you might find interesting.

1.9 When you participate in the Torrid Ambassador Program
If you participate in Torrid’s brand Ambassador Program (an overview of which can be found here: Ambassador Program), in addition to the information set forth in Section 1, we may also collect Protected Classification Characteristics. These Protected Classification Characteristics may include age (40 years or older), sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), and sexual orientation. Torrid uses this information to maintain a diverse group of program ambassadors.

If you are invited to join the Program, you will be required to create a profile on the Aspire influencer marketing platform (“Aspire”), located at https://aspire.io/. We do not control and are not responsible for Aspire or its collection or use of your information. You may find out more about how Aspire collects, stores, and uses your information by accessing the Aspire privacy policy available at https://aspire.io/privacy.

Your participation in Torrid’s brand Ambassador Program is subject to the program Terms and Conditions. If you have not done so already, please review the program terms and conditions located at https://aspire.io/terms-of-service/.

1.10 When you chat with us using the Chat Feature
If you use the Chat Feature of the Services to chat with a customer service representative we will have access to a transcript of the chat session. We use information provided though the Chat Feature to provide you with customer assistance and improve the overall customer experience.

We use a third party vendor, currently ContactUS, to provide the Chat Feature. The information you provide through the Chat Feature is collected by and stored on ContactUS systems. We do not control and are not responsible for ContactUS or its collection or use of your information. 2. Who We Disclose Your Information To
We may share your Personal Information with vendors, service providers, or other third parties under the following circumstances or as otherwise described in this Privacy Policy:
  • With Service Providers, Contractors, and Agents. We may share your Personal Information with third parties who perform services on our behalf, such as payment processing, data analysis, email and hosting services, or customer service and support. These service providers may access your personal data and are required to use it solely to provide our requested service.
  • With Contest or Promotional Sponsors. If you participate in a contest, promotion, sweepstakes, or similar events, we may share your information with any companies or sponsors who are running the event. For example, this might include sharing a list of winners.
  • Social Media Platforms. If you link or sign in with your social media accounts through our Sites or Apps, we may share your Personal Information with those third party social media sites. For example, we may share your Torrid loyalty account information with the social media site.
  • With Our Marketing Partners. We rely on other third parties to help us audit the quality and effectiveness of advertisements, to serve advertisements or marketing material, provide analytic services, and similar services. We may share some of your information with these marketing partners so they can perform these functions.
  • With Your Permission. With your consent or at your request, we may share information to third parties outside the scope of this Privacy Policy.

3. Information Regarding Children
Our Site and Services are intended for users who are 13 years or older and we do not knowingly collect information from children under 13 years old. If we become aware that we have collected information from a child under 13 years old, we will delete such information from our records. If you are a parent or legal guardian and believe your child has given us information and you did not provide consent, please contact us at privacy@torrid.com or 866-867-7431.

4. California Specific Rights
If you are a California Resident, you may have additional rights under the California Consumer Privacy Act (“CCPA”).

If we collected Personal Information about you in your role as an applicant, employee, or independent contractor, this Policy does not apply. Please contact Human Resources at TDHumanResources@torrid.com if you have questions about Personal Information related to your application or work with Torrid. Additionally, if we collect Personal Information about you in your role as an employee, owner, director, officer, or contractor of a commercial client, investor, or developer this Policy does not apply.

4.1 The Right to Request More Information
You may have the right to request more information about how we have treated your Personal Information in the past 12 months, including:
  • The categories of Personal Information we collected about you;
  • The categories of sources from which we collected that information;
  • Our business or commercial purpose for collecting or selling that information;
  • The categories of third parties with whom we shared that information; and
  • The specific pieces of Personal Information we collected about you.

4.2 The Right to Request Access
You also may have the right to receive a copy of your Personal Information.

4.3 The Right to Request Deletion
Under certain conditions, you have the right to request that we delete your Personal Information. Please note that simply logging out or uninstalling an app does not delete your account or the Personal Information we may have collected.

4.4 How to Exercise these Rights
To submit a request to exercise these rights you may use one of these three methods: For all requests, please clearly state that the request is related to “Your California Privacy Rights,” indicate which type of request you are making, and provide your name, street address, city, state, zip code and an e-mail address or phone number where we may contact you. We are not responsible for notices that are not labeled or sent properly or that do not include complete information.

4.5 Verification
Before responding to your request, we must first verify your identity using Personal Information you recently provided to us. If we are not able to verify your request we will contact you for more information. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.

4.6 Designating an Authorized Agent
You may designate someone to submit requests and act on your behalf (an “Authorized Agent”). To do so, you must provide us with written permission to allow your Authorized Agent to act on your behalf.

4.7 Do Not Track Requests
As explained in our Cookies and Advertising Policy, we use cookies to collect information about your internet activity to help us provide you with relevant advertisements, incentives or offers. Some web browsers or smartphones have the ability to set “Do Not Track” requests to block user activity from being tracked across web pages or devices. Our Site does not recognize “Do Not Track” signals.

4.8 Sharing Personal Information
If you are a California resident, you may request information about our disclosure of Personal Information to third parties or affiliated companies for their direct marketing purposes. To make such a request, please contact us at privacy@torrid.com. You must put the statement “Third-Party Marketing Opt-Out” in the subject field.

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. In the preceding twelve (12) months, we have disclosed we categories of third parties indicated in the chart below.

We may also share your personal information by selling it to third parties, subject to your right to opt-out of those sales. Our personal information sales do not include information about individuals we know are under age 16. In the preceding twelve (12) months, Torrid has sold the following categories of personal information to the categories of third parties indicated in the chart below. 4.9 Personal Information Sales Opt-Out
If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out"). We do not sell the personal information of consumers we actually know are less than 16 years old, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 15 years old, or the parent or guardian of a consumer less than 13 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales.

The CCPA requires notice and an opportunity to opt-out from certain disclosures of Personal Information considered a “sale” as defined in the CCPA. Torrid may collect your unique online identifiers, internet and network activity, device identifier, Internet Protocol address, browsing history, search history, and information about how you interact with our Site or App. We may disclose this information with third party marketing companies, social media platforms, or analytics partners that support our online marketing efforts, deliver meaningful ads to you, connect with social media networking, and help us improve the use of our Services.

4.10 No Discrimination
We will not unlawfully discriminate against you for exercising any of these rights.

5. Data Storage, Retention, and Security
Your Personal Information may be stored on servers in the United States and is subject to the laws of the United States, where the data protection and other laws may differ from those of other countries. Your Personal Information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the countries in which we operate.

We retain Personal Information in identifiable form only for as long as necessary to fulfill the purposes for which the Personal Information was provided to us or, if longer, to comply with legal obligations, to resolve disputes, to enforce agreements and similar essential purposes. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

We take precautions intended to help protect information that we process but no system or electronic data transmission is completely secure. Any transmission of your Personal Information is at your own risk and we expect that you will use appropriate security measures to protect your Personal Information.

You are responsible for maintaining the security of your account credentials for the Services. We will treat access to the Services through your account credentials as authorized by you. Unauthorized access to password-protected or secure areas is prohibited and may lead to criminal prosecution. We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. If you believe that information you provided to us is no longer secure, please notify us immediately using the contact information provided below.

If we become aware of a breach that affects the security of your Personal Information, we will provide you with notice as required by applicable law. To the extent permitted by applicable law, we will provide any such notice that we must provide to you under applicable law at your account’s email address. By using the Services, you agree to accept notice electronically.

Nothing in this Privacy Policy restricts Torrid’s ability to:
  • Comply with federal, state, or local laws;
  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;
  • Cooperate with law enforcement agencies concerning conduct or activity that the business, service provider, or third party reasonably and in good faith believes may violate federal, state, or local law;
  • Exercise or defend legal claims;
  • Detect security incidents and protect against fraudulent or illegal activity and prosecute those responsible for such activity; or
  • Transfer Personal Information as part of a merger or acquisition, dissolution of Torrid, or in the event of bankruptcy or any other transaction in which a third party assumes control of all or part of Torrid.

When you use this Site, you may find links to other websites we don’t own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of your Personal Information. 8. Updates to this Privacy Policy
This Privacy Policy is reviewed and updated regularly. If we change this Policy, we will post the updated Privacy Policy here, and those changes will go into effect on the “last updated” date shown above. We will not use or share your Personal Information for materially different purposes without first taking reasonable steps to provide you notice.
