Referral Program Terms & Conditions
As a member of Torrid’s Refer-a-Friend Program (a “Referrer”), you are subject to Torrid’s Terms and Conditions and Torrid’s Privacy Policy above as well as to the additional terms set forth in these Refer-a-Friend Program Terms. Please note that, unless we define a term in these Refer-a-Friend Program Terms, all capitalized terms used herein have the same meanings as in our Terms and Conditions.
As a member of Torrid’s Refer-a-Friend Program (a “Referrer”), you are subject to Torrid’s Terms and Conditions and Torrid’s Privacy Policy above as well as to the additional terms set forth in these Refer-a-Friend Program Terms. Please note that, unless we define a term in these Refer-a-Friend Program Terms, all capitalized terms used herein have the same meanings as in our Terms and Conditions.
- Definitions.
“App” will refer to the Torrid mobile app and all content within the app experience.
“Offer Codes” will refer to any links or codes that provide additional discounts or other benefits (such as free shipping) when applied to an order, either via following a specific link to the site or entering a code a checkout.
“Product” will refer to any merchandise item or items including but not limited to apparel, intimates and accessories. Gift cards, donations, tax, and shipping are not included in this definition.
“Purchaser” will refer to an individual customer of Torrid, as defined by the personally-identifiable information that belongs to the account used to make a purchase, as well as the shipping and/or billing information provided on an order.“Site” will refer to Torrid.com and all pages within the Torrid.com domain.
- Becoming a Referrer. Any individual who is otherwise eligible to participate may become a member of Torrid’s Refer-a-Friend Program by signing up using the “Refer a Friend” link provided by Torrid.
- Qualified Referral. A Qualified Referral is defined as a Product purchase (i) made via the Site or App by a person who (a) arrives to the Site by clicking on the unique Refer-a-Friend Program link (a "Referred Customer") provided to you by Torrid under the Refer-A-Friend Program, and (b) is a first-time Purchaser of Torrid products; and (ii) that has a total value of at least US$25.00 (excluding taxes, discounts, shipping charges, returns, cancelled transactions, and any applicable third party fees); (iii) and the unique referral discount is used; and (iv) the Referred Customer has not canceled or returned the purchased product. The Referrer's unique referral link may not be shared, sold, or used in any way except by the Referrer alone to obtain Qualified Referrals; referral links shared to or obtained through other sources (such as through a posting to a third-party intermediary or website) will not be honored. Referrers are limited to one (1) Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals.
- Referred Customer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address), as determined in Torrid’s sole discretion.
- Referral Rewards. For each Qualified Referral, the Referrer will receive a gift card in the amount of US$10.00 (“Referral Reward”). Referral Rewards will be issued within 7 days after the Referred Customer has received the purchased product and has not returned or canceled the order in accordance with Torrid’s returns policies. Referral Rewards will be fulfilled via Tremendous and can be redeemed at a variety of brands which are subject to change without notice. Each individual Referrer can only obtain a maximum number of fifty (50) Qualified Referrals, for a maximum possible Referral Reward of $500.00, within a twelve month period. As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards.
- Eligibility. Torrid’s Refer-a-Friend Program cannot be used by businesses or individuals for affiliate lead generation or posted on discount sites.
- No Combination. Referred Customers may not combine any discounts obtained through their use of the Refer-A-Friend Program with any Offer Codes or other promotions offered by Torrid.
- Compliance with Law. As a Referrer, you agree to comply with all applicable law, including, but not limited to the CAN SPAM Act. Any distribution of your Refer-a-Friend Program link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your Online Account and exclusion from Torrid’s Refer-a-Friend Program.
- Right to Terminate Accounts. Torrid reserves the right to terminate the Account of any Referrer and/or Referred Customer at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any Referrer and/or Referred Customer’s conduct to be in violation of these Refer-A-Program Terms.
- Right to Cancel Program or Change Terms. Torrid reserves the right to cancel the Refer-a-Friend Program and to revise these Refer-A-Friend Program Terms from time to time. If Torrid makes any material changes to these Refer-A-Friend Program Terms, Torrid notify you of those changes by posting them on the Site or by sending you an e-mail or other notification. If the Refer-A-Friend Program is terminated, any unclaimed Referral Rewards will be forfeited at that time.
